In force from 5 July 2026 until revoked. These terms apply to the purchase of the travel eSIM data plans offered on esimpont.hu.
2.1. Matters not regulated in these terms are governed by Hungarian law — in particular Act V of 2013 (Civil Code), Act CVIII of 2001 on electronic commerce services, Government Decree 45/2014 (II. 26.) on consumer contracts, and Government Decree 373/2021 (VI. 30.) on the supply of digital content.
2.2. Placing an order on the website creates a contract concluded electronically between the User and the Provider. It does not qualify as a contract put in writing and is not subsequently filed. The language of the contract is the language in which the order was placed (the relevant language version of the website). The essential terms are set out in the confirmation e-mail and in the User's account.
2.3. The Provider may amend these terms unilaterally; an amendment takes effect on publication and does not affect orders already placed.
3.1. The Provider sells travel eSIMs and related mobile data plans with a defined data allowance and validity period (the “Service”). The Service is digital content not supplied on a tangible medium / a digitally supplied service: performance takes place by the electronic delivery of the QR code (activation data).
3.2. Using an eSIM technically requires an eSIM-capable, network-independent (unlocked) device. Checking that the device is compatible is solely the User's responsibility, before purchase. To help with this, the Provider publishes on its compatibility page a device list for information only, together with a manufacturer-independent self-check: dialling *#06# on the phone shows whether the device has an EID (eSIM identifier). The device list is indicative, cannot be exhaustive, and is not a warranty by the Provider that any particular unit is eSIM-capable — the same model name also exists without eSIM depending on region and variant, and a manufacturer may leave eSIM out of whole model lines (for example Samsung in the FE versions). In case of doubt the *#06# test is decisive, or you can ask us before buying at info@esimpont.hu.
3.3. The mobile network service is provided by the Provider's wholesale partner and its local network partners. Coverage, bandwidth and network availability depend on the local operators; stated speeds are indicative.
3.4. The validity period of a data plan starts on activation (first data use) and ends after the stated number of days or when the data allowance is used up — whichever comes first. Unused data cannot be carried over or refunded.
3.5. A purchased data plan must be activated within 12 months of purchase (by first data use). A plan not activated within that period expires and its value is not refunded. The eSIM profile itself (for the one-off profile fee) remains the User's beyond that point and can be topped up with a new plan for any country.
4.1. The prices shown are final prices including VAT. The display currency can be selected in the website header (forint, euro, złoty, Czech koruna, Romanian leu, US dollar, Serbian dinar); you are charged in the currency shown at checkout when you complete the purchase, and the invoice is issued in that currency. On the foreign-language pages the default is the currency of that market. If your card is denominated in a different currency, your bank may add its own conversion fee at its own rate.
4.2. Payment is made by card, Apple Pay, Google Pay or Link through the payment provider Stripe (Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland). Card details are handled solely by Stripe and never reach the Provider.
4.3. Where a price is obviously incorrect (e.g. 0 or a price wrong due to a system error), the Provider is not obliged to fulfil the order; it will inform the User without delay and refund any amount paid.
4.4. The Provider issues an electronic invoice for the purchase through the Számlázz.hu system (KBOSS.hu Kft.), delivered to the e-mail address given.
4.5. Gross prices include VAT according to the buyer's country of billing; the tax amount is itemised on the payment page and on the invoice. For business buyers with a valid EU VAT number, the reverse charge rules apply.
5.2. If the QR code is not available within 24 hours of payment, the User may report this to info@esimpont.hu; the Provider will act without delay and, failing that, refund the purchase price.
6.1. Consumers generally have a 14-day right of withdrawal without giving reasons (Section 20 of Government Decree 45/2014 (II. 26.), implementing Directive 2011/83/EU).
6.2. If the consumer withdraws before the QR code is delivered (e.g. payment has been made but the QR code has not yet been handed over), the Provider refunds the amount paid without delay and at the latest within 14 days, using the same means of payment.
6.3. A withdrawal statement may be made by an unambiguous statement sent to info@esimpont.hu.
7.1. The Provider performs defectively if, at the time of performance, the Service does not meet the quality requirements set out in the contract or by law (e.g. the QR code cannot be used to install the eSIM, or the plan cannot be activated).
7.2. In the event of defective performance, the consumer may primarily request repair (the provision of working eSIM/activation data); if that is not possible or the Provider does not undertake it, the consumer may claim a proportionate price reduction or withdraw from the contract. Otherwise the Hungarian Civil Code and Government Decree 373/2021 (VI. 30.) apply.
7.3. It is not defective performance if the cause lies in the unsuitability of the User's device (not eSIM-capable or SIM-locked), in incorrect device settings, or in a temporary outage of the local network for reasons beyond the Provider's control. The Provider gives prior information about the technical requirements as set out in section 3.2 — on the compatibility page, through the device list and by publishing the *#06# self-check; carrying out that check is the User's responsibility. The absence of eSIM capability in the device therefore does not in itself give rise to withdrawal, a price reduction or a refund. In such a case the Provider may decide, as a matter of goodwill, to refund the purchase price if the eSIM has not yet been installed and no data has been used on it; that decision rests on the Provider's discretion and creates no obligation for the future.
7.4. One eSIM (QR code) can be installed on one device; moving it to another device after installation is generally not possible for technical reasons. This limitation can be seen before purchase.
8.1. The Provider is not liable for damage arising from the coverage, quality or outage of local mobile networks, from a fault or unsuitability of the User's device, or from force majeure.
8.2. Towards consumers the Provider accepts liability within the framework of mandatory statutory provisions; no provision of these terms limits the rights a consumer has by law.
9.1. You may raise a complaint at info@esimpont.hu or on +36 30 372 4256. We answer written complaints on the merits within 30 days.
9.2. In a consumer dispute, the consumer may turn to the conciliation board competent for their place of residence. The board competent for the Provider's registered office is the Pest County Conciliation Board (1055 Budapest, Balassi Bálint utca 25. IV/2., Hungary, e-mail: pmbekelteto@pmkik.hu, web: panaszrendezes.hu). The Provider is obliged to cooperate in conciliation proceedings.
9.3. Consumers resident in another EU Member State may also contact their national European Consumer Centre and use the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr.
9.4. A consumer protection complaint may be filed with the competent Hungarian authority (fogyasztovedelem.kormany.hu).

11.1. These terms are governed by Hungarian law — provided that this may not deprive a consumer habitually resident in another EU Member State of the protection of the mandatory consumer protection rules of that state (Article 6 of the Rome I Regulation). Foreign-language versions of these terms are translations of the Hungarian text; in the event of any discrepancy, the Hungarian text prevails.
11.2. If any provision of these terms proves invalid, this does not affect the validity of the remaining provisions.
